Man shot in bathroom still waiting for compensation

In a follow-up to a BM Newswire reported back in April, 2005 [1], we've learned recently that the city of San Antonio has yet to reimburse Joseph Hardaway for injuries he sustained when an off-duty police officer accidentally discharged his weapon in the bathroom of an auto auction house [2].

"I was washing my hands, and all of a sudden, I hear two loud bangs. I really thought it was a bomb, it was so loud," Hardaway said. "I could have easily been killed. The bulk of the slug didn't hit me. If the slug had hit me dead center on my leg, it would have taken it completely off."

Officer Craig Clancy, as you may remember, had the gun tucked into his belt band, instead of holstered, as it should have been, according to Mr. Hardaway's attorney. When Clancy's pants hit the floor, the gun went off. Twice. Officer Clancy was originally suspended for ten days, but gave up three vacation days, instead. The Office of Internal Affairs opened an investigation, but dropped it after Clancy's suspension ended.

So now Hardaway is left with nothing but a fragment of metal lodged permanently in his leg. While the auction house's insurance company has offered to pay the nearly $2,000 in emergency and after-care medical expenses, the plaintiff has declined, saying it's "too little, too late." He is suing the city and the business for a combined $500,000 in damages.

So we ask: who is to blame, and who should pay up? Should the business with the bathrooms be blamed for bullets banging into bystanders? Or should Craig Clancy come clean and consider coughing up cash for his crime?
